Terms and Conditions

1. About ASISTORIA
ASISTORIA provides commercial software services for restaurants and businesses. Our flagship product, RECLAIM, helps restaurants operate direct ordering, branded web and app experiences, payments, restaurant operations, delivery management and support under their own brand.
These terms apply when you use asistoria.co.uk, create an account, submit an enquiry, request support, subscribe to RECLAIM, or use any ASISTORIA client portal or related service.
2. Business use
ASISTORIA services are intended for business use. By creating an account, submitting a restaurant build request or subscribing, you confirm that you are authorised to act for the business you provide details for.
If any consumer protection law applies to you personally, nothing in these terms removes rights that cannot legally be excluded.
3. Accounts and security
You are responsible for keeping your login details secure and for activity that happens through your account.
You must provide accurate account, restaurant, billing and contact information, and keep it up to date through the client portal or by contacting ASISTORIA.
We may suspend access if we reasonably believe an account is being misused, accessed without permission, or used in a way that could harm ASISTORIA, clients, users or third-party services.
4. RECLAIM setup and launch
The one-time setup fee covers configuration and launch work for your restaurant platform, including website setup, restaurant branding, menu migration, payment integration, staff onboarding, driver setup and launch assistance where included in your package.
You are responsible for supplying accurate menus, prices, allergens, images, branding assets, opening hours, delivery settings, business policies and any legal information required for your own restaurant platform.
Project timelines depend on timely access to the information, approvals, domains, Stripe details and other materials requested from you.
5. Subscriptions and billing
Subscription billing is processed through Stripe. Prices, setup fees, trial or first-month arrangements, renewal dates and payment terms are shown at checkout, in your Stripe records and in the ASISTORIA client portal where available.
Your first month may be included after launch where stated on the Pricing page or in a written agreement. After that period, the monthly subscription renews automatically unless cancelled in accordance with these terms and Stripe billing settings.
You are responsible for maintaining a valid payment method. Failed payments may lead to restricted access, paused support or suspension of services until payment is resolved.
6. Cancellation
You can request cancellation or manage an eligible subscription through the client portal or Stripe billing portal where available.
Cancellation stops future subscription renewals. Unless stated otherwise in writing, setup fees, completed setup work, consumed subscription periods and third-party costs are not refundable.
After cancellation, ASISTORIA may retain account, billing, support and operational records where needed for legal, tax, security, dispute or legitimate business purposes.
7. Acceptable use
You must not misuse the website, portal or services, attempt to bypass security, upload unlawful content, interfere with service availability, reverse engineer protected systems, or use ASISTORIA services to process unlawful, misleading or harmful material.
You remain responsible for the legality and accuracy of restaurant content, customer-facing policies, offers, product information, allergens, delivery terms and payment information displayed through your own restaurant platform.
8. Third-party services
ASISTORIA uses trusted third-party providers including Stripe for payments and Resend for transactional email. Your use of those features may also be subject to the relevant provider terms, policies and availability.
We are not responsible for outages, restrictions, fees or account decisions made by third-party providers, but we will take reasonable steps to support you where a provider issue affects your ASISTORIA service.
9. Intellectual property
ASISTORIA owns or licenses the software, code, design systems, product concepts, documentation and platform materials used to provide the services, except for client content and assets supplied by you.
You retain ownership of your restaurant branding, menus, images and content supplied to ASISTORIA. You grant ASISTORIA permission to use those materials as needed to provide, support and improve the agreed services.
10. Support and changes
Support is provided according to your subscription, written agreement and available ASISTORIA support channels.
We may improve, update, modify or retire features over time. We aim to preserve production stability and will avoid changes that materially reduce paid functionality without reasonable notice where practical.
11. Liability
ASISTORIA will provide services with reasonable care and skill. However, software services can be affected by internet issues, third-party providers, hosting incidents, payment provider availability, user error and factors outside our control.
To the fullest extent permitted by law, ASISTORIA is not liable for indirect loss, loss of profit, loss of revenue, loss of goodwill, loss of data caused by your own actions, or business interruption arising from events outside our reasonable control.
Nothing in these terms limits liability that cannot legally be limited, including liability for fraud or fraudulent misrepresentation.
12. Privacy
How ASISTORIA collects, uses, stores and shares personal data is explained in our Privacy Policy.
13. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction unless mandatory law requires otherwise.
